Terms of Service

By using Hividai's web tools or mobile applications, you agree to these terms. Please read them carefully — especially the sections on content liability and user responsibility.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Hividai ("we," "us," or "our") governing your access to and use of the Hividai website at hividai.com, all associated sub-domains, and the Hividai mobile applications for iOS and Android (collectively, the "Services").

By accessing or using any part of the Services, you confirm that you are at least 16 years of age (or the minimum age of digital consent in your jurisdiction, whichever is higher), that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree to these Terms, you must immediately cease using the Services.

2. Description of Services

Hividai provides an artificial intelligence-powered media enhancement utility, including:

  • AI Image Enhancer — Automatically improves image quality, sharpness, and clarity using deep learning models.
  • AI Image Upscaler — Increases image resolution up to 4× using super-resolution neural networks.
  • Unblur Image Tool — Corrects motion blur, focus blur, and compression artifacts.
  • AI Video Upscaler — Enhances and upscales video content, available via the mobile app with full 4K/60fps capabilities.

The web-based tools are available without account registration for standard use. The mobile Pro application offers advanced features including 4K video upscaling, subject to applicable subscription fees.

3. Your Content & Ownership

Your content is yours. Hividai makes no claim to ownership of any images, videos, or other media files you process using the Service. You retain 100% copyright and all intellectual property rights in your original and enhanced content.

You represent and warrant that:

  • You own, or have all necessary licenses, permissions, rights, and consents to use and process the content.
  • Your content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.

Hividai accepts absolutely no responsibility for any content processed by users and expressly disclaims all liability arising from user-submitted content. You are solely responsible for the legality and integrity of all content you process.

4. Local & Temporary Processing

Strict processing rules. Hividai operates purely as a technical utility to enhance your media.

Web Tool (Images): 100% Local Processing

When you use our web-based image enhancement tools, all processing occurs 100% locally within your browser using WebGPU. Your images never leave your device, and they are never transmitted to, or stored on, our servers.

Mobile App (Videos): Temporary Processing

For heavy workloads like video enhancement on our mobile app, your files are processed on our cloud GPUs. All user-uploaded video files — both input and processed output — are automatically and permanently deleted from Hividai's servers within one (1) hour of processing. This deletion is absolute and irreversible.

No AI Training Use

Hividai does not and will not use your content to train, fine-tune, test, or develop any AI or machine learning model. This restriction is unconditional. Our AI models are trained exclusively on licensed datasets.

5. Acceptable Use Policy

You agree to use the Services only for lawful purposes. You agree that you will not:

  • Use the Services in any way that violates any applicable local, national, or international law or regulation.
  • Attempt to reverse engineer, decompile, or extract the underlying AI model weights from the Service.
  • Use automated scripts, bots, or scrapers to access the Services.
  • Overload, abuse, or attempt to interfere with the security or performance of our infrastructure.
  • Use the Services to process content belonging to others without their explicit consent.

6. Prohibited Content

Zero tolerance policy. Certain categories of content are strictly and unconditionally prohibited. Violations will result in immediate termination.

You are strictly prohibited from processing or using Hividai's Services in connection with any of the following:

Illegal Content & Child Safety

  • Any content that is illegal under applicable laws.
  • Any content that depicts, suggests, or could be used to produce child sexual abuse material (CSAM).

Non-Consensual Intimate Imagery (NCII)

  • Processing intimate or sexual images of any real person without their explicit and documented consent.

Synthetic Media & Deepfakes

  • Using Hividai's Services to enhance or upscale any AI-generated synthetic media (deepfakes) that depicts a real person in a false, misleading, or non-consensual manner.

NSFW & Explicit Content

  • Processing sexually explicit, pornographic, or obscene material of any kind. There are no "adult content" exemptions available on the Hividai platform.

7. Accounts & Subscriptions

Web Tool (No Account Required)

Standard web tool features are available without creating an account. Usage may be subject to rate limits to ensure fair access for all users.

Pro Mobile App Subscription

The Hividai Pro mobile application is available on a subscription basis through the Apple App Store and Google Play Store. Subscriptions automatically renew unless cancelled. Refund requests are handled entirely by Apple and Google. Hividai does not process refunds directly.

8. Service Availability

Hividai strives to provide continuous, reliable service but does not guarantee 100% uptime. The Services are provided on an "as available" basis. We reserve the right to suspend or restrict access to the Services for maintenance or abuse prevention without prior notice.

9. Absolute Zero Liability & Disclaimers

HIVIDAI IS PROVIDED STRICTLY AS A TECHNICAL SOFTWARE UTILITY ON AN "AS IS" AND "AS AVAILABLE" BASIS.

WE DO NOT MONITOR, STORE, OR CONTROL THE CONTENT YOU CHOOSE TO PROCESS. TO THE ABSOLUTE MAXIMUM EXTENT PERMITTED BY GLOBAL LAW, HIVIDAI EXPRESSLY DISCLAIMS ALL WARRANTIES, CONDITIONS, AND LIABILITIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

Hividai operates purely as a pass-through processing tool. We bear absolutely ZERO legal, financial, or moral responsibility for the media you choose to enhance, anywhere in the world. You use this tool entirely at your own risk. AI enhancement results are inherently variable, and Hividai makes no guarantee regarding the accuracy or suitability of enhancement outputs for any purpose.

10. User Responsibility & Limitation of Liability

YOU ARE 100% SOLELY AND EXCLUSIVELY RESPONSIBLE FOR EVERY IMAGE, VIDEO, OR MEDIA FILE YOU PROCESS USING HIVIDAI.

By using our Services, you explicitly acknowledge that Hividai has no visibility into, or control over, your local browser processing or your temporary cloud processing queue.

If you process illegal content (including but not limited to CSAM, non-consensual explicit content, deepfakes, or copyrighted material), YOU bear the sole legal, criminal, and civil liability. Hividai cannot and will not be held liable for copyright infringement, privacy violations, defamation, or any illegal acts committed by users.

UNDER NO CIRCUMSTANCES, UNDER ANY LEGAL THEORY OR JURISDICTION WORLDWIDE, SHALL HIVIDAI, ITS DEVELOPERS, OR OPERATORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LITIGATION, OR FINES ARISING FROM THE CONTENT YOU PROCESS OR YOUR INABILITY TO USE THE SERVICE.

11. Indemnification

You agree to defend, indemnify, and hold harmless Hividai and its employees, contractors, agents, and operators from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) any claim that your processed content caused damage or legal harm to a third party.

12. Termination

Hividai reserves the right to suspend or terminate your access to the Services immediately, without prior notice, if we determine that you have violated these Terms. Upon termination, your right to use the Services ceases immediately.

13. Governing Law & Jurisdiction

Since Hividai acts purely as a local and temporary processing utility, any legal disputes, copyright claims, or regulatory actions regarding processed content must be resolved by you, the user, under the applicable laws of your jurisdiction. Hividai claims no specific corporate jurisdiction for content disputes because we bear zero liability and exercise zero control over user actions.

14. Changes to These Terms

Hividai reserves the right to modify these Terms at any time. Your continued use of the Services after the effective date of any revised Terms constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Services.
